1. Agreement to Terms
These Terms of Use (“Terms”) govern your access to and use of the SoftHabits mobile application (“the App”), operated by SoftHabits (“we,” “our,” or “us”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
2. Eligibility
You must be at least 13 years old (or 16 in the EU/UK) to use SoftHabits. By using the App, you confirm that you meet this age requirement and have the legal capacity to enter into these Terms.
3. Your Account
You may use SoftHabits without creating a traditional account, but certain features (such as email-based communications) require you to provide an email address. You are responsible for keeping any information you provide accurate and up to date, and for any activity that occurs under your use of the App.
You may request deletion of your data at any time, either from within the App or by contacting us at the email listed at the end of these Terms.
4. Subscriptions, Trials, and Payment
SoftHabits is a paid subscription service.
- Annual subscription: Includes a 7-day free trial. At the end of the trial, your Apple ID will be charged for the annual subscription unless you cancel at least 24 hours before the trial ends.
- Monthly subscription: Begins immediately upon purchase. No free trial is available with the monthly option.
- Auto-renewal: All subscriptions automatically renew at the end of each billing period at the then-current price unless cancelled at least 24 hours before the renewal date.
- Payment: All payments are processed by Apple through your Apple ID account. We do not receive or store your payment information.
- Managing your subscription: You can view, manage, or cancel your subscription anytime in your Apple ID account settings on your device. Deleting the App does not cancel your subscription.
- Refunds: All purchases are handled by Apple and are subject to Apple's refund policy. Requests for refunds must be made directly to Apple.
- Price changes: We may change subscription pricing from time to time. Any price changes will take effect at your next renewal period and will be communicated in advance as required by Apple.
5. Health and Wellness Disclaimer
SoftHabits is a self-reflection and habit tracking tool. It is not a medical device, therapy, or substitute for professional advice.
The App is designed to help you observe your own behaviors and patterns. Nothing in the App constitutes medical, psychological, psychiatric, nutritional, or any other professional advice. SoftHabits is not intended to diagnose, treat, cure, or prevent any disease, mental health condition, or other illness.
If you are experiencing a mental health crisis or medical emergency, please contact a qualified professional or emergency services in your area.
6. Acceptable Use
When using SoftHabits, you agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws
- Attempt to reverse engineer, decompile, or extract source code from the App
- Use the App to harass, harm, or deceive others
- Attempt to gain unauthorized access to any part of the App or its underlying systems
- Use automated systems (bots, scrapers) to interact with the App
- Resell, redistribute, or sublicense access to the App or your subscription
7. Intellectual Property
The App, including all content, design, features, code, and trademarks, is owned by SoftHabits and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.
You retain ownership of any content you create within the App (such as the habits you track and any notes you add). By using the App, you grant us permission to store and process this content solely for the purpose of providing the service to you, as described in our Privacy Policy.
8. User Content
You are solely responsible for any content you input into the App, including habit names, notes, and reflections. You agree not to input content that is illegal, harmful, or violates the rights of others.
9. Privacy
Your use of the App is also governed by our Privacy Policy, available at https://softhabits.app/privacy. By using the App, you consent to the data practices described in that policy.
10. Third-Party Services
The App uses third-party services for analytics, error reporting, and subscription management (including PostHog, Sentry, RevenueCat, and Apple). Your use of the App is also subject to those services' terms where applicable. We are not responsible for the practices of these third parties beyond our own use of their services.
11. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the App will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not warrant that any insights, patterns, or information surfaced by the App will be accurate, reliable, or beneficial to your wellbeing.
You use the App at your own risk.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SOFTHABITS AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability will be limited to the maximum extent permitted by law.
13. Termination
We may suspend or terminate your access to the App at any time, for any reason, including violation of these Terms. You may stop using the App at any time by deleting it from your device and cancelling your subscription through your Apple ID account settings.
Upon termination, the provisions of these Terms that by their nature should survive (including disclaimers, limitations of liability, and intellectual property provisions) will continue to apply.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we'll update the “Last updated” date at the top and, for material changes, notify you within the App or by email if you've provided one. Continued use of the App after changes means you accept the updated Terms.
15. Apple-Specific Terms
You acknowledge that these Terms are between you and SoftHabits, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide support or maintenance for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. Apple has no other warranty obligations with respect to the App.
Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App will be resolved in the state or federal courts located in Maryland, and you consent to the personal jurisdiction of those courts.
If you are located in the EU or UK, mandatory consumer protection laws in your country of residence will continue to apply regardless of this provision.
